Commonly known as TUPE, The Transfer of Undertakings (Protection of Employment) Regulations were introduced in 2006 to protect the rights of employees when the organisation they work for is sold to another organisation or when there is a change in service provider. Failure to comply with TUPE can result in costly and time-consuming Court proceedings.
TUPE automatically transfers employees and any liabilities associated with them from the current employer to the new employer by operation of law.
